Procedures

  1. Library staff members normally having access to copying machines or printers will familiarize themselves with the copyright law. Staff is also required to know, or be able to refer to, basic criteria of "fair use," among which are the following:
    1. The copy must be used for private study, research or scholarship, and must not be used, either directly or indirectly, for commercial profit.
    2. A single copy (not multiple copies) may be made, and the single copy becomes the property of the customer.
    3. Copies of a whole work may not be made, only:
      •  A chapter from a book
      •  An article from a periodical or newspaper
      • A short story, short essay or short poem, whether or not from a collective work
      • A chart, graph, diagram, drawing, cartoon or picture from a book, periodical or newspaper
      • A video clip or sound clip
    4. Other criteria that may evolve in the future from test cases or from recognized copyright law authorities or interpreters.
  2. The library will maintain the required "Warning Concerning Copyright Restrictions" at or near each copying machine. (See Attachment A -below).
  3. A customer requesting a photocopy of copyrighted material available outside the Metropolitan Library System via Interlibrary Loan will be required to complete the appropriate form for that purpose. (See AM 200 Interlibrary Loan Procedures)
  4. The following fees will be charged for copying or printing any material:
    • Black and white - $0.10 per page
    • Color - $.50 per page
    • Microfiche copies - $0.25 per page

Notice Warning Concerning Copyright Restrictions

The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.

Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.

This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.
